Terms of Service

These Terms of Service govern your use of the Dolphi platform operated by Dolphi Australia Pty Ltd (ABN 43 675 811 720).
1. Acceptance of terms
By creating an account or using Dolphi, you agree to these Terms of Service and our Privacy Policy. If you are using Dolphi on behalf of a business, you represent that you have the authority to bind that business to these terms. If you do not agree, please do not use the service.
2. The service
Dolphi is a marketing operating system that helps small businesses plan campaigns, generate content using AI, and publish across multiple channels. We provide the platform, AI-generated content, and tools. You are responsible for reviewing, approving, and publishing all content. Dolphi does not guarantee specific business outcomes from campaigns run through the platform.
3. Your account
You are responsible for maintaining the security of your account credentials. You must provide accurate information when creating your account and keep it up to date. You must be at least 18 years old to use Dolphi. Each account is for a single business — do not share login credentials across different businesses.
4. Content ownership
You own all content you create or upload to Dolphi, including campaign briefs, business information, and approved content. AI-generated content becomes yours once generated within your account. You grant Dolphi a limited licence to store, process, and display your content solely for the purpose of providing the service. We do not claim ownership of your content.
5. AI-generated content
Dolphi uses artificial intelligence to generate marketing content. While we strive for accuracy and quality, AI-generated content may contain errors, inaccuracies, or inappropriate suggestions. You are responsible for reviewing all generated content before publishing. Dolphi is not liable for any consequences of publishing AI-generated content without adequate review.
6. Billing and payments
Paid plans are billed monthly or annually in Australian Dollars (AUD) through Stripe. Your subscription renews automatically unless cancelled. You can cancel at any time from your Settings page — your access continues until the end of the current billing period. Refunds are available within 14 days of your first payment if you are not satisfied. After 14 days, no refunds are provided for partial billing periods.
7. Fair use
Each plan includes a fair use allocation of AI generation credits, email sends, and storage. We reserve the right to throttle or suspend accounts that consistently exceed fair use limits. We will always notify you before taking action and give you the opportunity to upgrade or adjust your usage.
8. Prohibited use
You may not use Dolphi to: generate spam or unsolicited bulk communications; create misleading, deceptive, or fraudulent content; violate any applicable law or regulation; infringe on the intellectual property rights of others; distribute malware or engage in phishing; resell or redistribute the service without written permission; or attempt to reverse-engineer, decompile, or access the source code of the platform.
9. Service availability
We aim for 99.9% uptime but do not guarantee uninterrupted service. We may perform maintenance with reasonable notice. We are not liable for downtime caused by factors outside our control, including internet outages, third-party service failures, or force majeure events.
10. Termination
We may suspend or terminate your account if you violate these terms. You may delete your account at any time from Settings or by contacting us. Upon termination, we will delete your data within 30 days, except where we are required by law to retain it.
11. Limitation of liability
To the maximum extent permitted by Australian law, Dolphi's total liability to you for any claims arising from your use of the service is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.
12. Governing law
These terms are governed by the laws of New South Wales, Australia. Any disputes will be resolved in the courts of New South Wales. Nothing in these terms excludes or limits any consumer guarantees under the Australian Consumer Law.
13. Changes to these terms
We may update these terms from time to time. We will notify you of material changes via email at least 14 days before they take effect. Your continued use of Dolphi after changes take effect constitutes acceptance of the updated terms.
