These Terms of Service govern your use of the Dolphi platform operated by Dolphi (ABN 27 680 154 785). By using Dolphi, you agree to these terms.

1. Acceptance of Terms

By creating an account or using the Dolphi service, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the service.

2. Service Description

Dolphi is a marketing automation platform that generates marketing content for small businesses. The service includes campaign generation, content management, and publishing tools. We reserve the right to modify or discontinue features with reasonable notice.

3. Account Responsibilities

You are responsible for maintaining the security of your account credentials, all activity that occurs under your account, ensuring that your use of Dolphi complies with applicable laws (including the Spam Act 2003), and obtaining necessary consents before sending marketing communications to your customers.

4. Acceptable Use

You must not use Dolphi to generate or distribute spam, illegal content, or content that infringes third-party intellectual property rights. You must not attempt to reverse-engineer, scrape, or otherwise misuse the platform.

5. Intellectual Property

Content generated by Dolphi on your behalf is owned by you, subject to these terms. The Dolphi platform, including its software, design, and AI models, remains the intellectual property of Dolphi.

6. Payment and Refunds

Paid plans are billed monthly or annually in advance. Refunds are available within 14 days of initial purchase if you have not generated more than 2 campaigns. After this period, refunds are at our discretion.

7. Limitation of Liability

To the maximum extent permitted by Australian law, Dolphi's liability is limited to the amount you paid in the 12 months preceding the claim. We are not liable for indirect, consequential, or incidental damages.

8. Governing Law

These terms are governed by the laws of Victoria, Australia. Disputes will be resolved in the courts of Victoria.
